Police Interviews and Notice to Appear in Brisbane Do You Need Help Right Now?

If police have called you, come to your home, or sent you a letter asking you to come in for an interview — you need legal advice first. The same is true if you have been handed a Notice to Appear. That is a legal document that tells you when and where to go to court, and what charge you are facing.

This is one of the most common situations we help people with. A detective calls and asks you to “come in for a chat.” That sounds relaxed. It is not. Whatever you say in that conversation can be used against you.

What We Do Before Your Interview

Before you walk into any police station, we go over everything with you. We look at what the police are likely asking about. We give you honest advice about your options — including whether you should answer any questions at all.

One of our lawyers can come with you to the police station. Or if you prefer to go alone, we give you clear written instructions so you know exactly what to do and say. Either way, you go in prepared.

What a Notice to Appear Means

A Notice to Appear is not optional. It is a legal order under the Police Powers and Responsibilities Act 2000 (Qld). If you ignore it, a warrant can be issued for your arrest. The notice will tell you the charge, the court, and the date you must show up.

A lot of Notice to Appear cases come from incidents in Fortitude Valley — Brisbane’s main nightlife area. Common charges include public nuisance, assault, drug possession, and property damage. No matter what the charge is, getting advice early gives you the best chance of a good result.

Why Getting Help Early Makes a Difference

What you say to police gets recorded. You cannot take it back. We have seen cases where one comment — made with good intentions — turned a winnable matter into a very difficult one. Getting legal advice early is the best thing you can do for yourself.

Your Right to Silence in Brisbane- Do You Have to Answer Police Questions?

In Queensland, you generally do not have to answer police questions. This is called your right to silence. It is one of the most important legal rights you have — and one of the most misunderstood. You only have to give your name, date of birth and address to police when legally required.

People often tell their friends or family members to “just explain what happened” before calling a lawyer. That advice comes from a good place. But it can cause serious harm. If you are approached by police about a dispute with a neighbour — for example, in New Farm or Newstead — you are not required to give a statement. But you might not know that unless someone tells you.

When Staying Silent Helps — and When It Might Not

Staying silent is powerful, but it is not always the right move for every situation. Sometimes, giving limited and carefully managed information early can help — for example, if you have a clear alibi, or if giving certain information might stop charges from being laid at all.

Our job is to look at your specific situation and tell you what gives you the best chance. The Police Powers and Responsibilities Act 2000 (Qld) sets out exactly what police can and cannot ask you to do. We explain it in plain language so you can make a clear decision.

Common Situations in Brisbane’s Inner Suburbs

People in suburbs like New Farm and Newstead — quiet riverside areas near the Brisbane River — often get contacted by police over noise complaints, property disputes, or arguments with neighbours. Police may ask you to give a voluntary statement. Before you agree to anything, call us. Understanding your rights takes about five minutes. Undoing damage from a bad statement can take months.

Watch-House Help in Brisbane

The Brisbane City Watchhouse is on Roma Street. It is where most people who are arrested in the CBD, South Bank, and nearby suburbs are taken and held. If someone you know has been arrested, this is most likely where they are.

Weekend arrests are very common. If someone is arrested on a Friday night in South Bank or the CBD, they may stay in the watch-house until Monday morning before they see a magistrate. That is two or three nights in custody before their first court date.

How We Help People in Custody

People held at the watch-house have the right to speak to a lawyer before police interview them. This is important — once the interview starts, that chance is gone.

We can come to the watch-house in person, or we can give advice over the phone while someone is in custody. We cover what to say to the police, what not to say, and what will happen at the first court appearance.

If you are a family member trying to find out where your loved one is being held, we can help you work through the system and get in contact with them.

Location Matters

The Brisbane City Watchhouse is right next to the Roma Street Magistrates Court at 240 Roma Street, Brisbane. Our Eagle Street office is a short walk from both. Being close means we can move quickly on bail applications — and in custody matters, speed is everything.

Why Choose The  Criminal Lawyers Brisbane Group

19 Years of Experience — What That Really Means

Our Principal Solicitor has 19 years of criminal law experience across every court — from the Magistrates Court all the way to the High Court of Australia. We have handled everything from minor first-time charges to complex drug trafficking cases and homicide defence.

We want to be honest about what experience actually means. It means we have seen the patterns. We know what works in Brisbane courts and what does not. We know when a case can be won and when it is better to resolve it — and we tell clients the truth about that, even when it is hard to hear. That kind of honesty is more valuable than almost anything else a lawyer can offer.

A Small Firm That Stays With You

We are a small, focused firm. When you come to us, you work directly with the lawyer who knows your case. Not a junior who just read the file. Not someone different at every hearing. The same person, all the way through. In a serious criminal matter, that continuity makes a real difference.

We offer fixed fees wherever we can. We do this because we want you focused on your case — not worried about what the next bill might look like.

Close to the Courts

Our office is at Level 34, One Eagle Street, Brisbane CBD. We are just minutes from Brisbane District Court, Brisbane Supreme Court, Brisbane Magistrates Court, and the Brisbane City Watchhouse. When something urgent comes up — a bail application, an emergency hearing, a client who needs to be seen before court — we can move fast.

We help clients from all over Brisbane — Wynnum, Cleveland, Redcliffe, Pine Rivers, Strathpine, Holland Park, Sandgate, and everywhere in between.

Free Case Evaluation

Every new client gets a free case evaluation. No cost, no obligation. You get a real conversation with a lawyer who will tell you honestly what you are facing and what your options are. If police have already been in touch or you have been charged, do not wait. Call us today.

Frequently Asked Questions

Do I have to go to a police interview in Brisbane? Usually, you do not have to attend a voluntary police interview. But if you have received a Notice to Appear, that is different — it is a legal direction, and ignoring it can lead to a warrant for your arrest. Our honest advice: do not decide about any police interview before speaking to a lawyer. What happens in that room can have consequences that last years.

What should I say at a police interview? In most cases, say nothing beyond your name, date of birth and address until you have spoken to a lawyer. We know this feels strange, especially if you believe you have done nothing wrong. But everything you say gets recorded and can be used against you. The conditions of a police interview are set up to get information — not to give you a fair chance to explain yourself. A lawyer will look at your situation and tell you exactly what to do.

Can a lawyer come with me to a police interview? Yes. In Queensland, you have the right to have a lawyer with you at a police interview. We can come to the station with you. If there is not enough time for that, we can give you clear written instructions beforehand. Having a lawyer there means someone is in the room whose only job is to look out for you.

What happens if I am taken to the Brisbane City Watchhouse? You will be held at the watchhouse on Roma Street until police either release you on bail or bring you before a magistrate at Brisbane Magistrates Court. You have the right to call a lawyer while you are in custody. Use that right as early as you can — especially before any police interview. If you are a family member trying to find someone or help them, we can also help you understand what stage things are at and what needs to happen next.

How fast can you help with bail? Very fast. Brisbane Magistrates Court at 363 George Street deals with bail matters quickly. Our office is close by on Eagle Street, so we can prepare and act without delay. If someone in your family has been held in custody, call us straight away. Every hour between being remanded and having a proper bail application prepared makes a difference.
